Off the Mat Virtual Golf Inc. – Waiver & Release Agreement

This Waiver & Release Agreement (“Agreement”) is entered into by and between Off the Mat Virtual Golf Inc. (“Company”) and the undersigned participant (“Participant”). By creating a profile with Off the Mat Virtual Golf Inc., the Participant acknowledges and agrees to the following terms and conditions:

1. Assumption of Risk

Participant understands that golf and golf simulator activities involve inherent risks, including but not limited to: damage to personal property, damage to Company property, personal injury, or injury to others.
Participant voluntarily assumes all risks related to participation in activities at Off the Mat Virtual Golf Inc.

2. Equipment & Property

Participant agrees to use only white, unmarked golf balls provided or approved by the Company. Colored balls, balls with markings, stamps, or damage are strictly prohibited, as they may damage simulator equipment.
Participant will be held financially responsible for any damage to simulator screens, equipment, facilities, or property caused by failure to follow this rule.
Participant is responsible for their own golf clubs and personal belongings. The Company is not liable for lost, stolen, or damaged personal property

3.Behavior & Conduct

Participant agrees to behave in a safe, respectful, and responsible manner at all times.
Disorderly conduct, abuse of alcohol, foul language, harassment, or unsafe behavior will result in immediate termination of play and removal from the premises.
Any damage to Company property caused by reckless or inappropriate behavior will be the financial responsibility of the Participant.

4. Liability Waiver

To the fullest extent permitted by law, Participant releases, waives, and discharges Off the Mat Virtual Golf Inc., its owners, employees, contractors, and affiliates from any and all liability for personal injury, property damage, or loss arising from participation in activities at the facility.
Participant agrees to indemnify and hold harmless the Company from any claims, demands, or causes of action arising from their actions, conduct, or use of Company property.

5. Acknowledgment

By creating a profile with Off the Mat Virtual Golf Inc., Participant confirms they have read, understood, and agreed to this Waiver & Release Agreement. This Agreement shall remain in effect for all current and future use of the facility.

By clicking “I Agree”, I confirm that I have read and accept the terms of this Waiver & Agreement, which applies to all my future use of the facility.
